The latest multiple-use

Pop-up shops!  What is a pop-up shop?  They are defined by someone who provides them as “temporary retail spaces that sell merchandise of any kind … Pop-up shops are taking over the retail world and rethinking traditional brick-and-mortar and big-box stores…”    The National Forest Foundation apparently had to jump on this bandwagon with Busch beer.  So here you go …. ,  a pop-top pop-up shop, coming to a national forest near you.

Conservation lands in many places have been overrun by crowds attracted by social media.  This seems like it has the same potential.  It would be interesting to look at the NEPA analysis for these permits.  (Do you suppose it’s in grizzly bear habitat?)

Utah vs. Nevada

In a discussion of “privatization,” Brian Hawthorne suggested here that, “It might be worthwhile discussing our perceived distinctions between what Utah’s HB 148 contemplates vs the “small tract sales” made pursuant to the SNPLMA.” That would require some knowledge of what both of these things are.

This summary of Utah’s H.B. 148 is from a review by an attorney from the conservative Federalist Society.

Recent legislation passed in the State of Utah has demanded that the federal government extinguish title to certain public lands that the federal government currently holds. The State of Utah claims that the federal government made promises to it (at statehood when the federal government obtained the lands) that the federal ownership would be of limited duration and that the bulk of those lands would be timely disposed of by the federal government into private ownership or otherwise returned to the State.

On March 23, 2012, Governor Gary Herbert of the State of Utah signed into Utah law the “Transfer of Public Lands Act and Related Study,” (“TPLA”) also commonly referred to House Bill 148 (“H.B. 148”). This legislation demands that the federal government “extinguish” its title to an estimated more than 20 million (or by some reports even more than 30 million ) acres of federal public lands in the State of Utah by December 31, 2014. It also calls for the transfer of such acreage to the State and establishes procedures for the development of a management regime for this increased state portfolio of land holdings resulting from the transfer.

This is from the Southern Utah Wilderness Association, described by another poster here as “unwilling … to compromise with any other interest group.”

HB 148 requires, among other things, the federal government to transfer title of federal public lands in Utah to the state before January 1, 2015.  These public lands include lands managed by the Bureau of Land Management, Forest Service, U.S. Fish and Wildlife Service, and National Park Service.

  • They include, among others, sensitive sites such as Grand Staircase-Escalante National Monument, Glen Canyon National Recreation Area, and all national wildlife refuges in the state.
  • This would also include the overwhelming majority of remarkable red rock lands surrounding Moab, the San Rafael Swell, and Grand Gulch.
  • The Legislature has indicated that some of these lands would be sold outright to the highest bidder while others would be kept in state ownership but opened to oil and gas drilling, off-road vehicle use and extractive industries.
  • The bill does not require the transfer of national parks, wilderness areas, or certain national monuments and national historic sites.

Here is a summary of the Southern Nevada Public Land Management Act (from this OIG Report).

Las Vegas, one of the fastest growing cities in the United States, is landlocked by federal lands. Over the past decade, the population has increased by more than 60,000 people per year. To accommodate this rapid growth and expedite the disposal of federal land, Congress enacted SNPLMA in 1998 (Public Law 105-263, 31 USC 6901). SNPLMA allows BLM to sell federal land (about 27,000 acres) primarily through public auctions, establish a special U.S. Treasury interest-bearing account, and use the resulting receipts for educational and environmental purposes and capital improvements. In addition, SNPLMA directed BLM to transfer ownership of about 5,200 acres of land in the McCarran Airport Cooperative Management Area (CMA) to Clark County to help the County enforce regulations concerning airport noise within the CMA. BLM is entitled to 85 percent of any receipts from the sale, lease, or other conveyance of CMA lands.

I’m afraid I don’t see much similarity. The justifications are at opposite ends of the scale from a localized problem to a disagreement about overall management policies. The difference in the affected area is huge.  There are benefits returning to the American public from the Las Vegas land sale proceeds.  Perhaps it’s a slippery slope (next Los Angeles, Salt Lake City, Missoula …?), but H.B. 148 represents the bottom of that slope.

Michigan national forest considering banning alcohol on wild and scenic rivers

This is probably just another run-of-the-mill people management issue that taxes the limited recreation management resources of the Forest Service; here’s what happens when natural places get so popular they attract people who are not there to enjoy the nature part.  The ban would be about “safety and environmental issues on our National Wild and Scenic Rivers,” and maybe there are some wild and scenic rivers act requirements at the bottom of this (the forest supervisor spent some time at OGC).  (But it’s mostly interesting to me because I’ve been on these rivers, long ago).

Mining by the Ouachita National Recreation Trail

I found three things interesting about this situation.  Legally, I think there is a problem if the environmental analysis for a mine fails to say anything about the proximity to or the effects on a national trail and its users.

Bo Lea, president of FoOT, told The Sentinel-Record Jan. 15 that the Ouachita National Recreation Trail is a 223.5-mile premiere hiking and biking trail, and FoOT’s concern was that project’s environmental assessment made “no mention of the Ouachita Trail except for one map that shows a 150-foot buffer between the trail and the mining area. That’s only 50 yards.”

The Forest seems to be assuming that the buffer will fully mitigate any effects, but that has to be disclosed and supported by some analysis.

Politically, this area is in the Congressional district of Bruce Westerman, who has become renowned for proposing anti-environmental riders to Forest Service legislation.  At least he is consistent:

“I’ve long supported sustainable mining in the 4th District, provided it benefits local communities and stewards natural resources well,” Westerman said Tuesday in an email. “I look forward to the results of the Quartz Mine’s environmental review, and hope to see it progress in the upcoming year.”

Lastly, this is an area that is promoted for mountain bike use by the Forest Service and organizations that appear to support both hiking and biking.  It’s an “epic” biking trail, and it doesn’t go through any wilderness areas.

Should dry forests be considered suitable for timber production?

Recent research is showing that lower elevation forests are not regenerating after fires as they have historically.  From the abstract of the research cited in this article:

“Results highlight significant decreases in tree regeneration in the 21st century. Annual moisture deficits were significantly greater from 2000 to 2015 as compared to 1985–1999, suggesting increasingly unfavourable post‐fire growing conditions, corresponding to significantly lower seedling densities and increased regeneration failure. Dry forests that already occur at the edge of their climatic tolerance are most prone to conversion to non‐forests after wildfires. Major climate‐induced reduction in forest density and extent has important consequences for a myriad of ecosystem services now and in the future.”

One of those consequences should flow from NFMA requirements for sustainability and ecological integrity.  To put that in simplistic terms, if the land “wants” to be non-forest in the future climate, we have to let it be non-forest.  And non-forested lands are not suitable for timber production, regardless of whether we could plant and maintain a plantation there.  I don’t recall seeing any discussion of this in forest plan revision material I have reviewed recently.  There is also requirement to use the best available scientific information, so a suitability evaluation of low-elevation forests should go beyond what is currently growing there to address what would be expected there in the future.  Many national forests could end up with fewer suitable acres.

Ugly Americans get involved in travel planning

“The debate over snowmobile access in the Tahoe National Forest has taken an ugly turn with a spate of emails, social media posts and online comments filled with foul and abusive language.

Several people pushing for more restrictions on snowmobiles in the 800,000-acre forest that straddles the Sierra Crest have been the targets of online abuse.

The problem has gotten bad enough that Forest Service officials disabled a portion of the online comment system when they suspected people used it to target other commenters with nasty emails.”

This is a symptom of a much bigger problem in this country right now, but the problem it causes federal agencies is that they will have to start questioning the results of the public comment process where there is any indication that people have been intimidated from participating.

Months Late Park Service Releases Report on Climate Change

I posted a note on claims of possible censorship earlier, along with a very long time lag in waiting for the report to be released. Now we wait to see if anyone sees anything amiss. And we, at least I, wonder whether the earlier outcry had any impact on the final product that appears to be unsanitized. Here is a snip from The Hill, 5/21/2018:

The National Park Service (NPS) released a major report on rising sea levels after the Trump administration was accused of censoring it.

The Center for Investigative Reporting’s Reveal reported last month that administration officials removed mentions of human-caused climate change in the report, reflecting President Trump’s and Interior Secretary Ryan Zinke’s skepticism that manmade greenhouse gases are the main cause of climate change.

But the report released late Friday puts the blame for sea-level rise squarely in human hands.

“Human activities continue to release carbon dioxide (CO2) into the atmosphere, causing the Earth’s atmosphere to warm,” the report says.

“Further warming of the atmosphere will cause sea levels to continue to rise, which will affect how we protect and manage our national parks.”

NPS spokesman Jeremy Barnum said the report went through the usual editing process, and the agency is confident in its scientific accuracy.

Utopia or Dystopia: What comes next?

The other day at lunch with an old friend, our talk turned to optimistic and pessimistic outlooks regarding the future. He has been reading books by authors who are somewhat to highly optimistic about the future—basing their optimism on advances in science and technology. Two books he mentioned are Stuart Brand’s Whole Earth Discipline: Why Dense Cities, Nuclear Power, Transgenic Crops, Restored Wildlands, and Geoengineering Are Necessary (2009), and Steven Pinker’s Enlightenment Now: The case for reason, science, humanism, and progress (2017).

I mentioned that years ago I was asked to present a set of myths at a Forest Service “adaptive management” workshop in Santa Fe, NM. The first two myths were “Science will find an answer” and “Technology will save us.” I view science and technology as two-edged swords—working both toward our collective good as well as toward our collective detriment. It all depends on how we choose to use them.

When I got home I looked up both books. Brand’s book seems somewhat reasonable—in a Jack Nicholson “Maybe this is as good as it gets” way—judging the book by its title (and a few reviews I found). Both books seem to fall into the trap I identified at the Santa Fe meeting.

I found an interesting review of Pinker’s book by Ian Goldin in Nature.

Here is a snip from Goldin’s review of Enlightenment Now:

Although it is framed as a historically informed template for a new age of reason, Enlightenment Now ultimately becomes something else: an extended dismissal of the arguments of despair that Pinker fears are defining politics and crowding out an alternative approach rooted in rationality and global cooperation. He does not frame the thesis in economic terms. Yet he essentially defends globalization and the growth of market economies by claiming that it has brought more progress than any force in history. As an economist, I agree.

So do I. But I also agree with Goldin’s other arguments:

But globalization has also led to an escalation of risks. What is rational for individuals is increasingly irrational for society. The drivers of progress are rising incomes and connectivity; these also lead to greater negative spillovers and systemic risk. Managing globalization’s underbelly is essential, and the gulf between what needs to be done and what is being done is widening. Economic growth has come at the expense of ecosystems. Because nature does not respond to price signals (rhinos do not reproduce more when their horns are more valuable), increasing freedom of choice has led to overexploitation of a growing number of natural systems. Pinker does cite climate change, but as a worrying exception to a relentlessly positive narrative, rather than as the most glaring example of a wider failure of global commons management.

Goldin concludes with a precautionary note:

I share Pinker’s optimism that this could be our best century, in which poverty and many of the challenges humanity has historically confronted are addressed. Yet there is also a real potential for dystopian outcomes as sea levels, strife, temperatures and resistant infections rise, and biodiversity, democratic institutions, social ties, mental health and resource security are eroded. We need to face up to these and other daunting challenges while nurturing the positivity required to tackle them.

Enlightenment Now is not a balanced account of the present or future. But for the many overwhelmed by gloom, it is a welcome antidote.

I’m more pessimistic than Goldin. Even though I agree that this century could be our best chance to extract ourselves from what may be a lemming-like mass approach toward the edge of a cliff, it seems an unlikely prospect to me. On the other hand the dystopian outcomes seem more likely. But who am I to make such “likelihood” calls. Then again, who is? I regret that I won’t be around long enough to see much of what happens.

I guess I’d have to read Enlightenment Now to see if I agree with Goldin’s call that it is a “welcome antidote” for “the many overwhelmed by gloom.”

As for Brand’s outlook, take a look at what he and coauthors call An Ecomodernist Manifesto (2015).

The Ecomodernist Manifesto is hopeful, if a bit too hopeful as to humanity’s ability to rise above our worst natures. It seems somewhat reasonable at least in these ways: 1) Nature is recognized as a positive good, with suggested safeguarding of both ecosystems and species diversity highlighted, 2) market economics is relegated to secondary role, not a primary driver of all that is good, …. It seems overly optimistic in its portrayal (or lack thereof) of people’s ability to get from the edge of dystopia to the future they propose. And it is optimistic as to the roles portrayed be technology and development. But it was written in 2015, or 1 BT (BT: Before Trump).

On a hopeful note of my own, if we don’t now and continuing forward from here slip into deep dystopia, Trump and others like him on the world stage may ironically give us the wake-up calls we desperately need.

“The Insatiable Appetite for People to Come Here”: Interview with Scott Fitzwilliams, White River NF Supervisor

The Denver Post printed an interview with Scott Fitzwilliams, the White River NF Supervisor last week. Has your local paper done a similar interview with a Forest Supervisor? If so, please link in the comments below. It might give us a different perspective on regional variation in “what’s happening on/challenging” the National Forests.

Here’s a link to the whole story. Needless to say, there’s a lot of ski resort stuff in the interview.

DP: There’s legislation in Congress that would enable the Forest Service to retain a portion of revenue-based fees collected from ski areas on public land. That could be huge for the White River. Fee retention is not a new idea. The 2004 Federal Lands Enhancement Act enabled forests like the White River to retain some recreation fees. How has that worked out for you guys?

S.F.: It’s made all the difference. In this forest we are able to retain about $1.3 million in fees from outfitter guides, Maroon Bells, Vail Pass, campgrounds that are nonconcessioned. Since we have been able to do that with a clear and concise and rather firm direction from Congress that those fees go toward supporting the program that generated the fees, we have been able to invest in things like trails, trailheads and maintenance of that, for example, our outfitters and guides use. Frankly that has been lifesaver for us. If you were to model this fee retention proposal similarly, we have a proven track record that we make good use of fees.

DP: Crowds in the White River forest have led to some innovative management strategies with plans for permitting at hotspots such as Vail Pass, Hanging Lake, Maroon Bells and Conundrum Hot Springs. What are some of the challenges in deploying those kinds of management plans?

S.F.: Resort-based recreation is major part of our niche, but really what shapes this forest is the interstate. It really does. We look to a future where that’s not going to stop no matter how they get here, whether it is light rail or extra lanes. What we are talking about it how we create a scenario where we can get people on the forest, enjoy the forest and maybe in more developed pods or in shorter-duration experiences they can get right off the Interstate 70 corridor. It’s a tough time to do it, but where we have to be in the future is really looking at this I-70 corridor, where we have maybe webs going off into the Roaring Fork Valley and places like that. The insatiable appetite for people to come here is not going to change.

It’s this combination of managing and providing the experience because that’s what we do and it’s super important and if we want support for our public lands. Putting up a sign that reads “Sorry. The park is closed,” or overly restricting people is not the way to get support for conservation of public lands or a sustainable environmental ethic. These types of decisions and planning processes I think we will see more of in the future. I’m not sure where the next one is. Some of the more popular fourteeners around the state are being talked about. Again it’s not us outright trying to limit access. It’s more about managing people space and time. These are hard processes. To do it right it takes time.
