New Report: Climate Change Could Cripple Southwestern Forests

From the University of Arizona:

Combine the tree-ring growth record with historical information, climate records and computer-model projections of future climate trends, and you get a grim picture for the future of trees in the southwestern United States.

That’s the word from a team of scientists from Los Alamos National Laboratory, the U.S. Geological Survey, the University of Arizona and other partner organizations.

If the Southwest is warmer and drier in the near future, widespread tree death is likely and would cause substantial changes in the distribution of forests and of species, the researchers report this week in the journal Nature Climate Change.

Abstract


As the climate changes, drought may reduce tree productivity and survival across many forest ecosystems; however, the relative influence of specific climate parameters on forest decline is poorly understood. We derive a forest drought-stress index (FDSI) for the southwestern United States using a comprehensive tree-ring data set representing AD 1000–2007. The FDSI is approximately equally influenced by the warm-season vapour-pressure deficit (largely controlled by temperature) and cold-season precipitation, together explaining 82% of the FDSI variability. Correspondence between the FDSI and measures of forest productivity, mortality, bark-beetle outbreak and wildfire validate the FDSI as a holistic forest-vigour indicator. If the vapour-pressure deficit continues increasing as projected by climate models, the mean forest drought-stress by the 2050s will exceed that of the most severe droughts in the past 1,000 years. Collectively, the results foreshadow twenty-first-century changes in forest structures and compositions, with transition of forests in the southwestern United States, and perhaps water-limited forests globally, towards distributions unfamiliar to modern civilization.

Char Miller on the “Park Service= More Bucks” Question

We have discussed this topic on the blog before. Thanks to Char for putting the questions out there in a well-written and researched piece here called “The San Gabriels: A National Forest? A National Park? Does it Matter?”. Thanks for setting our sights on the big strategic question.

There was so much good stuff that it was hard to pick an excerpt, so I just pulled the last few paragraphs.

It remains an open question, then, whether an NPS-managed recreation area would be an improvement over the current national forest. Neither agency currently has the requisite funds to sustain the forests, meadows, rivers, and beaches, trails, cabins, and lodges it stewards across the country. Like the heavily used Angeles National Forest, the Park Service’s major urban recreation areas, including the Santa Monica Mountains, Golden Gate, Delaware Water Gap, Lake Mead, and Gateway, are showing a lot of wear and tear, direct consequences of years of declining budgets, staff reductions, and deferred maintenance; the same situation is bedeviling the management of our wildlife refuges, conservation preserves, and iconic parks. We may proclaim that the public lands are national treasures, but we treat them like dirt.

Nothing will alter this situation unless we mount a serious national discussion about these lands’ real value, human and environmental. Our debate over the future of the San Gabriels and the Angeles National Forest could stimulate this much-needed larger conversation. But only if we ditch the hyperbolic rhetoric, confront the harsh budgetary climate, and admit that political tradeoffs will compromise whatever choice we make.

If we stay the ax and start telling the truth, we’ll be in a better position to make decent public policy.

Forest Service logs (err, “thins”) old-growth to help aspen

Earlier this summer Sharon had a post titled, “Tree vs. Tree: An Aspen Restoration Project,” which looked at some of the issues surrounding the Tahoe National Forest’s “Outback Aspen Restoration Project.”

Well, this morning, the Sacramento Bee’s Tom Knudson took another look at the project, this time with local residents, who are not too happy with the Forest Service and with the Tahoe National Forest supervisor, who is not too disappointed with the project.  Although, in fairness, the Forest Service supervisor did decide to halt logging (or do we call it “thinning?”) of trees 40 inches in diameter or greater on the remaining 190 acres of the project.  Here are some highlights from the article:

Standing amid a scattering of stumps last week, an official from the U.S. Forest Service acknowledged the agency made mistakes by logging too many pine trees, including majestic old-growth giants, in an effort to help another Tahoe species: the quaking aspen.

But he rejected calls from local residents that the Tahoe National Forest sharply scale back the cutting along Independence Creek north of Truckee.

“Are there places where there are some trees that I’ve seen out here – some live trees still standing and some stumps – that I would have preferred be marked for retention? Yes,” said Tom Quinn, supervisor of the Tahoe National Forest….The extensive cutting has incensed residents and conservationists, who were out in force at Friday’s meeting.

“We are shocked at the situation, the catastrophic damage being done by our government with absolutely no care for public input,” said Mary Leavell, who grazes cattle in the national forest with her husband.

“We all ultimately want forest health,” said Lauren Ranz, who lives part-time on a former 450-acre ranch near the logging zone. “But I don’t think this is the way to get it.”

Despite his concerns about cutting too many large, old trees, Quinn defended the project…He said the agency’s decision to allow the cutting of old-growth trees was consistent with the goal of aspen restoration, even though it angered neighbors.  “They were probably social mistakes, more than ecological mistakes,” he said of the agency’s actions.

To try to quell criticism, Quinn announced that Forest Service officials have decided to halt logging of conifers 40 inches in diameter or greater on the remaining 190 acres of the 479-acre project. But he rejected suggestions to limit cutting to trees 30 inches in diameter or less….

“I’m extremely disappointed,” said Fred Mitchell who lives on 80 acres near where the cutting is taking place. “There are so few trees 40 inches and above, anyway.

“They’re brushing off the public like we are a minor nuisance, like we don’t count for anything,” Mitchell added.

Mitchell is one of a group of residents who have marshaled opposition by handing out flyers, contacting lawyers, political representatives and environmentalists, even placing mock tombstones on the stumps of large trees – some more than two centuries old – that have been logged.

“It’s not what they told us it would be,” said Gary Risse, a part-time area resident who is among those opposed. “I can tell you without a doubt there was no mention of clear-cuts whatsoever. That would have stopped it.”

…Chad Hanson, director and staff ecologist for the John Muir Project, said other agency projects have succeeded with less intense cutting.

“Scientific studies … do not support the assumption that you need to clear-cut forests, especially 150 feet or more away from aspen stands, or that you need to remove old- growth trees,” he said. “That is not scientifically necessary.”…

“I’ve covered about 300 acres of this project looking for legacy (old-growth) trees,” Mitchell said. “From what I can gather, there has only been one legacy tree left for every four and a quarter acres, which is not a very good number.”

21st Century Problems.. Recreation Bucks and Different Solutions-The San Gabriels Otra Vez

I thought it was interesting that on the previous post on the role of concessionaires (here), many of our usual readers did not weigh in. I don’t know what that means.. certainly we will have recreation funding problems, whether or not we do fuel treatments on the national forests and how that debate finally turns out. Maybe we are missing the forest for the trees..;). What do most taxpayers get from the national forests? Water, some wood, some energy, but mostly recreation.

It seems like there are currently two responses to “not enough money”… 1) give it to the Park Service (which gets funding from exactly the same place) or 2) use concessionaires. I would propose another, “design a funding process for the Forest Service that everyone (at least on this blog) can support, and then lobby the heck out of Congress”. For example, what if retirees, the conservation community and AFSEEE all joined together for heavy duty grassroots lobbying?

I would be interested in what you think of my idea, plus what are your ideas?

What triggered this was another article about trashed public land, with the answer (again) being getting the bucks from another pocket of Uncle Sam.

Here’s the link to the LA Times article, and below is an excerpt. The subtitle of the article is:
“Cutbacks leave rangers outnumbered in dealing with car burglaries, drug deals, gold prospectors and rowdy parties along the mountain creek.”

Beautiful and clean may have been an apt description in the past. But it doesn’t fit today. Although water quality monitors say the East Fork is safe to swim in, the vicinity of the swimming hole was fouled by dozens of dirty diapers and, on some rocks midstream, human feces.

“I’ve lost count of the times I’ve pleaded with the Forest Service to get the trash out of the river,” said Mark Yeltsin, manager of the Camp Williams Cafe, the only commercial establishment on the East Fork. “They have a stock answer: ‘Sorry. We don’t have the resources.'”

Tom Contreras, supervisor of the 640,000-acre Angeles National Forest, said a few more rangers and cleanup crews would certainly enhance his ability to enforce laws on the river, but budget restraints have made that all but impossible. “We have one full-time technician assigned to that area — I wish we had more,” Contreras said.

Environmental and community groups say conditions have reached critical mass, not only on the river but across the San Gabriel Mountains. Something needs to change.

“We desperately need a new vision and management plan for the East Fork and the entire range,” said Juanna Torres, a spokeswoman for the Sierra Club. “What we’ve got up there now isn’t working.”

San Gabriel Mountains Forever, a coalition of community and environmental groups including the Sierra Club and Friends of the River, is backing a plan that seeks to balance the crush of tourists with conservation. Essentially, it would transform the San Gabriels into a national recreational area co-managed by the National Park Service. The designation would make it eligible for additional federal resources, including law enforcement officers, interpretive signs and trash collection.

The National Park Service is completing a study of the proposal for submission to Congress and possible authorization next year.

What, there is need for law enforcement, but it needs to be “designated” before the funds will be available? I think something smells funny, but it isn’t the piles on the rocks, it’s something about the current budget process.

Bozeman’s water supply less vulnerable to fire

The Gallatin National Forest’s Bozeman Watershed Logging Project has been the subject of much debate and commenting here at the blog.   Well, it appears as if the next chapter of the story has been written, as the Bozeman Daily Chronicle took another look at the issue in this morning’s paper.  Excerpts from the article are highlighted below [emphasis added]:

This summer’s Millie fire prompted renewed calls for thinning the forests south of Bozeman to protect the city’s water supply from fire. However, upgrades to the water plant are nullifying the argument that the water supply needs protection.  The Bozeman water plant’s antiquated filtration system, built in 1984, couldn’t filter much more sediment than what is carried by the streams on a normal day. Any increase in the amount of sediment in Bozeman or Hyalite creeks was a source of concern.

But that will change when a new $43 million system comes online in a little more than a year, said water treatment supervisor Rick Moroney. Construction started a year ago.  “It adds an important extra step – sedimentation – which makes it vastly superior,” Moroney said. “I can’t guarantee it could handle everything, but it will be able to handle the sediment from a fire.”

The new facility removes the urgency from one side’s argument in what is now a 2-year-old battle over a forest-thinning project.

In March 2010, the Gallatin National Forest published its Bozeman Municipal Watershed Project, a plan devised with the city to harvest, thin and burn 4,800 acres in the Hyalite and Bozeman creek watersheds.

The $2 million project had the stated objective of protecting the watersheds that provide 80 percent of the city’s summer water supply from being polluted after a severe fire. But wildfire doesn’t pose the only risk to water quality.

The Alliance for the Wild Rockies, the Montana Ecosystems Defense Council and the Native Ecosystems Council opposed the project because more than seven miles of new logging roads would be required, and such roads can add as much sediment to area streams as a fire….

Hydrologist Mark Story said decades of research show roads are responsible for 90 percent of the sediment produced during logging. The groups argued thinning wouldn’t prevent a wildfire, which would add still more sediment.  “There’s no science that will fireproof a watershed,” said Michael Garrity of the Alliance for the Wild Rockies. “We have no problem with thinning as long as they can do it without building roads that are just as bad for the watershed.

 

Fire scientists continue debate in the comments section

Last week this blog featured a couple of recent news articles with fire scientists discussing their latest research and understanding of the role severe fire plays in some western landsacpes.  One of those articles I highlighted was Emily Guerin’s piece over at High Country NewsFire scientists fight over what Western forests should look like.”

Swetnam and Brown “…questioned how ponderosa pines could regenerate if Baker and Williams are correct about severe fires having scarred Western landscapes for generations.” They regenerate the same way most wingless pine seeds do–by animal dispersal. I have numerous photos of Clark’s nutcrackers and Mexican jays extracting seeds from cones on severely burned ponderosa pines (see photo evidence on our facebook page here: http://www.facebook.com/AvianScienceCenter). The more you learn about severe-fire ecology, the more it all makes sense–plant, beetle, and bird adaptations that are apparent even in many of our dry mixed-conifer forest types!

In the artice Malcolm North incorrectly states that the General Land Office data used by Williams and Baker is a “very scant data set” that does not allow for extrapolation to the landscape scale. In fact, this GLO data comprises thousands of sites over entire landscapes. The data used by Williams and Baker, in fact, is by far the largest data set ever used to address the historic occurrence of high-severity fire in ponderosa pine and mixed-conifer forests. As for the comments by Swetnam and Brown, who imply that ponderosa pine and mixed-conifer forest does not naturally regenerate after high-severity fire, this assumption is contradicted by the scientific literature. Savage and Mast (2005) (Table 3) found hundreds of stems per hectare of natural regeneration following high-severity fire in Southwest ponderosa pine forest. Haire and McGarigal (2008) and Haire and McGarigal (2010) had similar findings, indicating substantial natural regeneration of ponderosa pine and other tree species even in large high-severity fire patches, especially within about 200 meters from the edge of high-severity fire patches (which accounts for most of the area experiencing high-severity fire), and lower but still significant levels (for the purposes of establishing new forest stands) even farther than 200 meters into high-severity fire patches. Similar results have been reported outside of the Southwest in mixed-conifer and ponderosa pine forests (Donato et al. 2006, Shatford et al. 2007, Donato et al. 2009, Collins et al. 2011 [Plumas Lassen Study 2010 Annual Report]). There are likely numerous mechanisms for this, including seed survival (which may occur more often that some assume), dispersal by animals, and dispersal by wind.

Hey, all I know is what the photo above shows: recent high severity fires in Front Range ponderosa pine forests are not coming back as dense even-aged stands of trees. Far from it, in fact. That photo was taken this past June, almost 10 yrs to the day after Hayman took out about 50,000 acres of forest with nary a living tree left. You could search for days for a seedling that was not planted by either FS and Denver Water (they’ve planted a few 1000s of acres, but still a lot of treeless landscape out there). Maybe those corvids are busy as bees somewhere, but they’re not having much luck with re-establishing those 50,000 acres very fast. And it’s not just Hayman; wander around in any recent fires in the Front Range and see how treeless those areas still are.

And this is in the exact same area we reconstructed fire history before the fire (published in 1999) that was the first fire history in a ponderosa ecosystem that provided concrete evidence of crown fire. But the crown fire patches we reconstructed were acres to 10s of acres in size, not the 1000s to 10000s of acres we’re seeing today.

And hence the crux of the question: what was the scale of crown fire relative to surface fire in the historical forest, and how has that changed today? No one disputes that *passive* crown fires occurred (where fire spread across the landscape was primarily through surface fuels, but occasional trees or patches or trees would crown), whereas current fires are dominated by *active* crown fires (with fire spread mainly through aerial fuels). One other point about the uncharacteristic nature of recent fires, at least Hayman: 400-600 yr old trees we sampled in our 1999 study that had recorded multiple fire scars (i.e., had experienced 6, 8, 10, 15 *surface fires* in their lifetimes) all died during Hayman. Hanson, I have to laugh every time I see your report on “the myth of catastrophic fire” [link here, added by MK] because in the cover photograph there is what looks to be a dead tree that takes up the entire left side of the photo, with what sure looks to be a catface with maybe 8-10 fire scars recorded in it. An incredibly unintended ironic comment on your entire thesis in that paper. Here’s a tree that experienced 8-10 surface fires in its lifetime, and then dies in a recent high-severity fire.

The picture above is indeed instructive; it shows that there are no big ponderosa pines! Why? They were all harvested before or after the severe fire event…might that have something to do with the fact that there is little recruitment? The more unnatural treatment a forest gets, the more unnatural the result.

The fact that charcoal trees have fire-scars is also instructive. Of course fire-scarred trees eventually burn down…that’s the point! If they didn’t burn down every 300 years or so, on average, they’d live 4,000-5,000 years, just as the other tree species that REALLY have a history of avoiding severe fire do. A little more perspective from evolutionary ecology might help here.

Again, nobody is arguing that some dry PIPO forests are in an unnatural state, and getting unnatural results from recent fires…the BIG point is that the story applies to a small proportion of western forests, and to almost none of the mixed-conifer forest types.

A while back on this blog here, I wondered about Ark Initiative’s ongoing interest in Burnt Mountain (800 trees 6.5 acres, and mass extinctions).

Fortunately, a reporter for the Aspen Times had the time and the skills to investigate more.
Here’s a link and below is an excerpt.

“What exactly is the Ark Initiative, and why is it interested in Burnt Mountain? It’s largely a one-person operation run by environmental consultant Donald “D.J.” Duerr, who helped found the organization and serves as its president and director. Duerr is a veteran of the conservation movement who has a reputation of being very capable but also very difficult to work with. One source, who asked not to be quoted by name, said Duerr isn’t a team player and often thinks his approach is the only approach to an issue.

Duerr created the Ark Initiative in the late 1990s. The organization’s website, http://ark.savelifenow.org, says it is “dedicated to protecting life, including human life. Our highest priority is halting the global mass extinction.”

The website says the Ark Initiative works on a “wide variety of life preservation issues,” but none are cited. The organization’s finances are also closely guarded — more so than many other environmental nonprofits. Nonprofits are required by the Internal Revenue Service to fill out a Form 990 on their finances. The website Guide Star posts the forms, with the cooperation of the nonprofits, so it provides reporters, prospective donors and interested members of the public with a glimpse at an organization’s operations. The Ark Initiative’s financial forms aren’t available through Guide Star. Duerr didn’t respond to a request by The Aspen Times on Monday to provide Ark Initiative’s latest annual report, nor did he respond to repeated requests for an interview.

So far, it’s been impossible to tell from public records where the Ark Initiative’s money is coming from for the Burnt Mountain fight.

A limited amount of information is available about Ark Initiative at the Wyoming secretary of state’s website. In addition to listing Duerr as president and director, Leila Bruno, of Laramie, Wyo., is the treasurer and director. Sylvia Callaway, whose mailing address is in care of an Austin, Texas, residence, is listed as vice president and director.

The extent of the Ark Initiative’s environmental activism is difficult to gauge. Public records indicate Duerr submitted comments to the Forest Service to oppose two timber sales: one in Wyoming in 2009 and the other in South Dakota in 2010.”

Interesting. I had heard through the rumor mill that it was a neighbor who didn’t want more people skiing around.. it’s possible that “keeping out the riff-raff” will be hard to distinguish from legitimate environmental concerns. Again, thanks to the Aspen Times for investigating.

Lawsuit filed against CE logging in IRA, WSA, RNA and Old-Growth

We’re discussed the appropriate, or inappropriate, use of Categorical Exclusions (CE’s) by the Forest Service in the past (here and here).  What about a CE for a 17,000 acre logging project that includes logging within Inventoried Roadless Areas, Wilderness Study Areas, Research Natural Areas, and old growth forests? Is a CE really an appropriate level of analysis and public input for such a project?   Clearly some folks think not.  The following is a press release from the Alliance for Wild Rockies and the Native Ecosystems Council.  A copy of the complaint is here.

The Alliance for the Wild Rockies and Native Ecosystems Council filed a lawsuit on Friday in Federal District Court against the Forest Service to stop the Little Belt Mountain Hazard Tree Removal Project in the Lewis and Clark National Forest.  The Forest Service plans to log 17,000 acres on National Forest Lands, including logging in Inventoried Roadless Areas, Wilderness Study Areas, Research Natural Areas, and old growth forests.  The Forest Service authorized these activities under a Categorical Exclusion from the environmental analyses required by the National Environmental Policy Act.

“Up until now the Forest Service has done a full environmental analysis on large roadside logging projects,” said Mike Garrity, Executive Director of the Alliance for the Wild Rockies.  “We didn’t oppose the agency on those projects, but in this case the agency is excluding itself from the requirement to keep the public informed of the environmental effects and to provide public input on the proposal.  Categorical Exclusions were intended for purposes such as mowing the lawn at the Ranger Station or painting outhouses, not logging over 17,000 acres.”

“Herbicide spraying and logging will occur in several already degraded watersheds and along several streams that are considered ‘impaired’ due to sediment,” Garrity explained.  “These areas provide habitat for the westslope cutthroat trout and the Western toad, both are considered ‘sensitive species’ on the Forest and both will be impacted by logging – especially when you consider approximately 1,700 acres of logging and herbicide spraying will occur within 150 feet of streams.  The result will be to dump more sediment into already degraded streams where these native fish are struggling to survive”.

“I have recently driven roads in the Little Belt Mountains and there is evidence of the mountain pine beetle epidemic, but it is in patches, not forest wide,” explained Sara Johnson, Director of Native Ecosystems Council and former Gallatin National Forest biologist.  “Where the beetles have killed trees next to the road, firewood cutters have already done a good job cutting them down.  It’s a mystery why the Forest Service wants to log 17,000 acres of so-called ‘hazardous trees’ when there isn’t a hazard. The only hazard will be to the native wildlife when 17,000 acres of important habitat is clearcut and to the taxpayers who have to pay for it.”

“There are already massive infestations of noxious weeds, such as thistle and houndstongue, along roads,” Johnson said.  “They can’t control the weed problem now and logging will just make it worse.”

“The Canada lynx, listed as ‘threatened’ under the Endangered Species Act, has historical presence on the Forest including recent sightings in the project area. Lynx, wolverine, black-backed woodpecker, Northern goshawk, Western toad, and Northern three-toed woodpecker all are known to occur in the area and their numbers will be further reduced by these massive clearcuts,” concluded Johnson.

“We support logging to protect public safety,” Garrity said.  “But the public needs to be kept informed to ensure that the Federal Government is following the law. The public needs to be shown that there is a real safety hazard and not just an imagined excuse for more subsidized logging.

“It is unfortunate that we have to ask the court to intervene to force the Federal Government to let the public be involved in the management of our National Forests, Garrity concluded.  “But in the end, we firmly believe the public should have a say in the management of public lands…even if we have to go to court to get it.”

Conservationists Fight Timber Industry’s NFMA Lawsuit Seeking To Limit Role Of Science

The Western Environmental Law Center, on behalf of Klamath Siskiyou Wildlands Center and Oregon Wild, filed a motion today in federal district Court in Washington D.C. to fight a lawsuit that aims to drastically limit the use of science to help manage our national forests.

Led by the timber industry, a coalition of industry groups filed suit on August 31 to challenge the new planning rule for the national forest system, designed provide for sustainable management of 193 million acres of national forests across the country. The purpose of the industry group’s lawsuit is to prevent the Forest Service from using “best available science” and ecosystem management tools to guide decisions affecting national forests, and to prohibit the agency from maintaining “viable populations” of wildlife, among other legal claims.

Conservation groups are seeking to intervene in this lawsuit in order to ensure the use of sound science in decisions affecting the public’s air and water, and our children’s natural heritage.

“These industry groups have a scary vision for our national forest,” stated Joseph Vaile, Program Director for the Klamath Siskiyou Wildlands Center (KS Wild) an Oregon-based conservation organization. “Never before have we seen extraction industries so clearly state that they oppose the use of science on our National Forests. Through this suit these groups hope the keys to our national forests are handed over to private industry so they can be turned into private tree-farms for their own benefit.”

“It comes as no surprise that the timber industry would like to see our National Forests managed for logging but it becomes truly bizarre when the timber industry must argue against science and in favor of crony capitalism in order to achieve their desired result,” said Doug Heiken, Conservation and Restoration Coordinator for Oregon Wild, another organization intervening.

Pete Frost, attorney for the conservation groups, stated, “This lawsuit, if successful, could effectively ban conservation biology as a basis to help craft how we manage our national forests. It is a throw-back to when only logging, grazing, and mining mattered.”

Water Quality, Abandoned Mine Cleanup and Liability: Help Wanted!

This is a serious environmental problem and perhaps “Something We Can All Agree On” as you can see, with an obvious solution. What I don’t get from this story, is “who could possibly be against it?” and “why on earth hasn’t the legislation passed?”. If anyone out there knows, please share…

Colorado mining authorities have dug through a mountainside and reopened the dark granite shaft of an abandoned mine that turned deadly – trying to find options for dealing with one of the West’s worst environmental problems.
The Pennsylvania Mine, perched above timberline, discharges an acidic orange stream moving 181 pounds per day of toxic metals into Peru Creek and the Snake River, which flow into Denver Water’s Dillon Reservoir.
The poisoning of the watershed has gone on for more than 60 years.
Yet state officials say the risk of lawsuits prevents cleanup of this mine and thousands of other abandoned mines that have impaired 1,300 miles of Colorado streams and, according to federal estimates, the headwaters of 40 percent of Western rivers.
Today’s digging reflects growing frustration. Colorado county governments recently resolved to lobby for congressional action as water quality and healthy mountain fisheries are increasingly important to the Western economy.
“The idea is to just get ourselves in there and see what the remedy might be,” said Bruce Stover, director of Colorado’s Office of Active and Inactive Mines, who was peering into the Penn Mine last week.
Orange slime – containing iron, cadmium, aluminum, mercury, zinc and lead – coats the walls of the mine 4 inches thick. The U.S. Forest Service and the Environmental Protection Agency paid for the use of heavy machinery to dig through 200 feet of collapsed mountainside to open the mine shaft.
Stover and contract workers are trying to unravel an underground spaghetti of side tunnels and fissures. If the main shaft were plugged, would toxic water back up inside the mine, where it could be neutralized? Or would the mine drain through other openings and spew toxic metals at multiple points across fragile tundra? That information could help determine how a cleanup could be done most efficiently.
But, for years, congressional leaders have refused to address the problem of legal liability at abandoned mines – despite repeated efforts by U.S. Sens. Michael Bennet and Mark Udall, both Colorado Democrats.
The EPA’s current interpretation of the Clean Water Act says “good Samaritans” and state governments embarking on projects to reduce the contamination of watersheds could be held liable for costs of full-scale cleanups costing millions of dollars a year to treat toxic water forever. This has prevented partial cleanups that, while not stopping all pollution, could improve water downstream.
“What we need in Colorado and across the country is federal legislation that enables the state and other parties to take smart and affordable steps at these sites,” said Loretta Pineda, state director of reclamation, mining and safety. “Right now, under the language of the Clean Water Act, we cannot take those steps without risking enormous financial liability.”
At the Penn Mine over the past year, state inspectors measured a boggling array of toxic metals discharged into Peru Creek. They counted 186 pounds of cadmium, 4,496 pounds of copper, 21,529 pounds of manganese, 21 pounds of lead and 39,896 pounds of zinc. These metals have left Peru Creek and much of the Snake River devoid of aquatic life.

This is what one person thought the reasons were: fear of environmentalist lawsuits.. and pushback by environmentalists.. could that possibly be true? And if so, what groups, and could they possibly be influenced?

But certain provisions in the federal Clean Water Act create major stumbling blocks to such efforts. The Clean Water Act likes big, perfect fixes – like permanent water treatment pants that cost millions to build and millions more annually to operate, and which convert toxic water into potable stuff that fish can cruise around in.

So-called Good Samaritans have had to walk away from more modest mine cleanup projects for fear that if they don’t bring the discharge water all the way up to CWA standards, they may be sued by a third-party citizen or even another environmental group.

Pat Willits, the executive director of the Ridgway-based Trust for Land Restoration, which helps communities deal with a myriad of issues related to abandoned mining, explains the liability problem like this: “Good Samaritans are spooked by the ‘citizen suit’ provision of the Clean Water Act, which says that if someone suspects a violation of the Clean Water Act, a citizen may begin a legal action and if successful, the defending party will have to pay all of the legal expenses of the citizen’s group. If they are unsuccessful, the defendant does not have recourse to countersue.”[…]

Two decades’ worth of efforts to shield would-be Good Samaritans legislatively by creating a new provision in the Clean Water Act (including, most recently, U.S. Senator Mark Udall’s Good Samaritan Cleanup of Abandoned Hardrock Mines Act of 2009), have floundered in Congress, due to fears from environmentalists about opening up the Clean Water Act, even for such benign and altruistic purposes as protecting Good Samaritans…

Lands (AML) Programs. The Forest is recognized as highly effective, knowledgeable and accomplished
in project work and has leveraged funding through partnerships and potentially responsible parties to
have a implemented a 5-year mine reclamation/restoration program of over $8.4 million dollars. As a
