Molloy: “Injunction more likely than project to harm grizzly bear”

HELENA, Mont. (AP) — An on-again, off-again logging project in the Kootenai National Forest may be going ahead after a federal judge refused to delay it during the appeal of a lawsuit that claims threatened grizzly bear habitat would be harmed.

The project, which calls for logging more than 900 acres and burning 2,140 acres, is based on sound science and should not harm the bears’ habitat, U.S. District Judge Donald Molloy wrote in his order Thursday.

“In fact, given the evidence, studies and analysis marshaled by the agencies, it could be postulated that enjoining the project is more likely to irreparably harm the grizzly bear than allowing the project to proceed,” Molloy wrote.

The 9th U.S. Circuit Court of Appeals had issued a two-week block on the Grizzly Project while Molloy was considering the Alliance for the Wild Rockies’ request for an injunction during the appeal of its lawsuit.

The conservation organization’s appeal challenges a previous ruling by Molloy allowing the project to proceed. The group originally sought an injunction from the 9th Circuit, saying the project would likely be completed before the appellate court had a chance to weigh in.

But the 9th Circuit judges ruled the group first had to make the injunction request to Molloy.

Molloy denied the request in his Thursday order. If the project goes ahead, the conservation group will again ask the 9th Circuit to block it, Alliance for the Wild Rockies executive director Mike Garrity said Friday.

The 9th Circuit’s temporary two-week block expires Monday. Quinn Carver, natural resources and planning staff officer for the Kootenai National Forest, said the contractor should not have any impediments to starting the logging project after that date.

Garrity disputed that, saying the Forest Service must first receive the appellate court’s permission to proceed with the project.

The differing accounts could not immediately be reconciled.

I couldn’t find who is the author of this piece, but I feel great empathy for journalists who attempt to delve in to these complexities. And that line is great and honest “differing accounts could not immediately be reconciled.”

Something different: White-nose syndrome of bats, and national forests

This hasn’t gotten huge attention in the West yet, but it will if and when (probably the latter) this wildlife disease arrives out here.  In the eastern U.S., this contagious fungal disease (first observed only a few years ago in New York and Vermont) has devastated several species of bats and obliterated some huge hibernating colonies, killing literally millions of bats. It has spread rapidly to westward and southward, and may be ready to make the leap to the Rockies. Federal and state wildlife folks are very worried about this disease, as they should be.

I’m not a bat expert by any means, but have been working on the epidemiology of this disease with colleagues from USFS and Idaho Fish & Game, both of whom are incredibly knowledgeable and devoted to the study and conservation of these animals.

I presented some of this work at the national WNS workshop in Boise last month, sponsored by FWS, ironically the same week that I was arguing a case in federal court just down the street against USFS and FWS. But as my FS colleague noted, we should never let a little lawsuit spoil a good friendship.

Tongass Timber Sale Update: How an endemic species can halt a timber sale

Earlier in September, a press release from the Greater Southeast Alaska Conservation Community (GSACC) was shared with this blog. It opened with:

On August 16, GSACC and four other organizations filed an administrative appeal of the Tongass Forest Supervisor’s decision to proceed with the Big Thorne timber project. The appeal went to to the next highest level in the agency, Regional Forester Beth Pendleton. The appeal is known as Cascadia Wildlands et al. (2013), and other co-appellants are Greenpeace, Center for Biological Diversity and Tongass Conservation Society.

The project would log 148 million board feet of timber [enough to fill 29,600 log trucks], including over 6,000 acres of old-growth forest from heavily hammered Prince of Wales Island. 46 miles of new logging roads would be built and another 36 miles would be reconstructed.

Today, we get an update on the Big Thorne timber sale on the Tongass National Forest in Alaska in the form of this article, written by Dr. Natalie Dawson, one of GSACC’s board members.

On the Tongass National Forest, we hear mostly about trees – whether it be discussions about board feet, acres of old growth, percentage of forest converted to “second-growth” or “the matrix”[*], our conversations tend to focus on the dominant plant species group that defines the rare “coastal temperate rainforest” biome. However, the Tongass is more than a forest, it is a conglomerate of islands, islands of different sizes, islands of different geologic and cultural histories, islands with or without black bears, grizzly bears, or wolves, the iconic species of Alaska. Because of these islands, there are unique, or, endemic, species of various size, shape and color across the islands. Though they have played a minimal role in management throughout the course of Tongass history, they are now rightfully finding their place in the spotlight thanks to a recent decision by regional forester Beth Pendleton.

On Monday (Sept. 30), the US Forest Service announced its decision to reconsider the Big Thorne timber project. This project would have been the largest timber project on the Tongass National Forest in twenty years, taking 6,200 acres of old growth forest (trees up to 800 years old, 100 feet tall, and 12 feet in diameter) from Prince of Wales Island, an island that has suffered the most intense logging in the region over the past six decades. It is also an island that is home to endemic animals found nowhere else in the world.

Citizens of southeast Alaska and environmental organizations including GSACC jointly filed an administrative appeal on the Big Thorne timber project on August 16th of this year. Monday’s response comes directly from regional forester Beth Pendleton. In the appeal, Pendleton cited an expert declaration written by Dave Person, a former Alaska Department of Fish and Game (ADFG) biologist with over 22 years of experience studying endemic Alexander Archipelago wolves on Prince of Wales Island, with most of his research occurring within the Big Thorne project area. Pendleton cited Person’s conclusion that “the Big Thorne timber sale, if implemented, represents the final straw that will break the back of a sustainable wolf-deer predator-prey ecological community on Prince of Wales Island…” Her letter states, “This is new information that I cannot ignore.” The response to the appeal requires significant review of the timber project before it can move forward, including cooperative engagement between the Tongass National Forest and the Interagency Wolf Task Force to evaluate whether Dr. Person’s statement represents “significant new circumstances or information relevant to” cumulative effects on wolves (including both direct mortality and habitat).

As one of my students today in class asked me pointedly, “So what does all this mean?” Well, it means that the largest potential timber sale in recent history on our nation’s largest national forest, on the third largest island under U.S. ownership, is temporarily halted under administrative processes due to an endemic species. It does not mean that this area is protected. It does not mean, that our work is done. Pending the outcome from conversations between the Forest Supervisor and the Interagency Wolf Task Force, especially under the current political climate within the state of Alaska, we may have plenty to keep us busy in the near future. It does mean that, even if only briefly, the endemic mammals of the Tongass National Forest received a most deserving moment in the spotlight. This could result in a sea-change in how the Tongass National Forest is managed.

This also means that science is being given a chance to play an important role in an administrative decision on our nation’s public lands, and two endemic species, the Alexander Archipelago wolf, and its primary prey species, the Sitka Black-Tailed deer, are forcing federal and state agency personnel to reconsider their actions. Science must continue to play an important role in the future of all activities on Prince of Wales Island. It is home to many endemic animals found only on a small percentage of islands on the Tongass National Forest, and nowhere else in the world. This lineup includes the Prince of Wales Island flying squirrel, the spruce grouse, the Haida ermine, and potentially the Pacific marten, which was only recently discovered on nearby Dall Island. The future of the Tongass timber program and human development on these complex islands are inextricably tied to ensuring a future for all other species in one of the world’s only remaining coastal temperate rainforests.

Dr. Natalie Dawson has done years of field work on endemic mammals throughout much of Southeast Alaska, studying their population sizes and distributions through field and laboratory investigations, and has published peer-reviewed scientific papers on these topics. She presently is director of the Wilderness Institute at the University of Montana and a professor in the College of Forestry and Conservation.

[*] What is the matrix? The conservation strategy in the Tongass Forest Plan establishes streamside buffers (no logging) and designates minimal old growth reserves, in an attempt to ensure that wildlife species on the Tongass remain viable. (Whether the strategy is sufficient for this is at best questionable.) The matrix is the expanse of habitat that is allocated to development (such as logging) or that is already developed, and which surrounds those patches of protected habitat.

UPDATE: Readers may notice that in the comments section a claim is made that the Sitka black-tailed deer are not endemic, but were were introduced. The Sitka black-tailed deer (Odocdileus hemionus sitkensis) were not introduced to Southeast Alaska; the Sitka black-tailed deer is indeed an indigenous, endemic species there.

Botkin Chapter 3: The Wolves and Moose of Isle Royale

Rather than provide a summary of Chapter 3, as I did with Chapter 2, I am reprinting a recent post by Dr. Ralph Maughan, an expert on wolves and a strong proponent of their reintroduction in former habitats: http://idahoptv.org/outdoors/shows/wolvesinidaho/maughan.cfm. The reason for doing this is that Maughan is commenting on the very focus of Botkin’s 3rd chapter, which starts with the story of his (Botkin’s) experiences researching the predator/prey relationships between moose and wolves on Isle Royale, an island in Lake Superior near the Canadian border that is over 200 square miles in size and contains 45 lakes of its own. What has made the island particularly interesting for this type of study is that it has never been heavily influenced by people; moose first arrived there from the mainland only about 100 years ago; and wolves didn’t arrive (except for a failed National Park Service attempt to establish them with zoo animals in the late 1940s) until the lake froze over more than 50 years later — after the moose had a half-century to build their population without a major predator to inhibit their reproduction.

As with Chapter 2, Botkin uses this story and others — sandhill cranes, Canadian lynx and microbes — to examine the “balance of nature” as it has been defined mathematically and as actually observed, to examine the differences between the two. I would like to thank Dr. Maughan for permitting me to repost his work here. Of the 72 comments on this topic on his blog, a significant number were my own in sometimes heated response to many of his regular commenters. Tree and Matthew will understand. It was my second visit there, and both times I seemed to stir up the natives with my thoughts and opinions — mostly because of the old “anonymous commenter” discussion. I think JZ first sent me there and after I went and got a similar reaction, he said he was just joking. Maybe it was Derek, but you will see the result if you read the comments, too.

I will leave it up to actual readers to determine their own thoughts on these two perspectives, but I’ll repeat Botkin’s analogy of “resilient stability” in regards to the “balance on nature” argument by his comparison of a person with a drink building a house of cards on a train: the house of cards will collapse with a bump or large vibration, but the drink will only slosh around before it returns to its former level. One is a fragile balancing act, and one is resilient. For me at least, that provides a clear metaphor for this discussion. Now for Maughan’s post:

Should the declining inbred wolves of Isle Royale N.P. be augmented?

Should there be genetic rescue (outside wolves brought in)-

For many years the wolves and moose of Isle Royale National Park in Lake Superior have shown that wolves do not wipe out their prey. When wolves become abundant enough that the disappearance of prey seems probable, the wolves die back.

On the other hand, when wolves have declined to few in number, the moose population expands and begins to decimate its prey — the moose-edible vegetation of the island.

This rough balance has existed ever since wolves colonized the island one hard winter. In 1949 a pair of wolves walked over to the island on the frozen lake. The pair found an island overrun with moose. The moose themselves had migrated to the island 40 years earlier.

The wolf population expanded, of course, and brought the moose number in check (and more). Then the wolves began to starve off and the cycle began.

The moose prefer aspen, and they do well eating it. However, they mostly wiped that out before the wolves came.  Ever since, they have relied primarily on the less nutritious balsam fir and lichens.

Both the moose and the wolves are also subject to inbreeding. It is especially a problem for the wolves, all of which descended from the original pair. So, in addition to the cyclic malnutrition when the moose population drops too low, the wolves have been seen to suffer from increasing genetic defects. One of these is poor reproduction even when there is enough food.

Down to just 8 wolves, they seem doomed without outside genes from new wolves. There have been up to 50 wolves at a time on the island, although many scientists think a stable number is about 25. It should be noted that there have always been wide fluctuations around this “mean.” The eight wolves seem to have gained a brief reprieve with the birth of 2 or 3 pups in 2013 after several years with none. Nevertheless, it is hard to see how the unaugmented population can survive much longer. It is less and less likely that the lake will freeze and wolves from Minnesota, Michigan or Wisconsin find their way to the island.

The wolves and their relationship to the moose and the vegetation have been studied since 1958. Dr. Rolf Peterson, in particular, is the person most closely associated with the studies. He would like to see some genetic rescue. Dr. Dave Mech, however, who is another avid student of the island’s wolves is reported to want to first let natural events play out.

With the wolf population so low, we would now expect the moose population to be expanding. It is. However, it is increasingly suffering from tick infestation. This is a problem for moose in general during winters, but Isle Royale has seen warmer winters as the climate changes. This makes the effects of the bloodsucking  arachnids more severe.

Rolf Peterson recently sent out the following letter.

The National Park Service is interested to receive your input on the pending decision regarding the future management of wolves on Isle Royale.  Please send your input to the following email address:

The Park Service is considering three options:  (1) do nothing, even if wolves go extinct; (2) allow wolves to go extinct (if that is what they do), and then introduce a new wolf population; or (3) conserve Isle Royale wolves with an action known as genetic rescue by bringing some wolves to the island to mitigate inbreeding.

While expressing your view, consider providing as much detail on the reasons for your preference, as the Park Service believes the reasons for your view are as important as your view.  If you have any questions on the process or anything relating to providing input, please do not hesitate to ask me.

Tour Red Shale Wildfire in the Bob Marshall Wilderness

The Great Falls Tribune and Helena Independent Record recently teamed up (whether they knew it or not) to present a fairly cool multi-media education about the Forest Service’s “let it burn” policy as it applies to the Bob Marshall Wilderness complex and this summer’s Red Shale wildfire.

Not surprisingly, the Forest Service is finding that following nearly 30 years of following such a policy in the Bob Marshall Wilderness complex, fuels have been reduced, wildlife habitat has been created and US taxpayers have enjoyed significant wildfire suppression cost savings (again, whether they know it or not).

First, I highly recommend watching this short video from the Great Falls Tribune. Mike Munoz, Rocky Mountain District Forest Ranger on the Lewis and Clark National Forest is interviewed and gives some of the recent wildfire history in the Bob Marshall, as well as some of the rationale and justifications for the Forest Service’s “let it burn” policy. The video includes some pretty cool GoPro footage from high about the Bob Marshall, so enjoy some of those images.

Next, Eve Byron of the Helena Independent Record has a more extensive story, parts of which are highlighted below.

Twenty-five years ago this month, the Canyon Creek fire roared out of the Scapegoat Wilderness after slowly burning unfettered for more than three months, deep within the mountains, under part of the so-called “let it burn” U.S. Forest Service policy.

Eventually, the Canyon Creek fire burned across more than one-quarter of a million acres, forced the deployment of shelters by more than 100 firefighters and threatened the town of Augusta.

The local firestorm of criticism over the Forest Service’s handling of the Canyon Creek fire lasted even longer than the conflagration. But valuable lessons were learned, and this summer, as the Red Shale fire was allowed to burn relatively unchecked through the wilderness, it did so with little fanfare.

Brad McBratney, the fire staff officer for the Helena and Lewis and Clark national forests, and Rocky Mountain District Ranger Mike Munoz smile at questions about various firefighting tactics used by the Forest Service, well aware that the public typically has a limited understanding of how decisions are made as to whether to try to extinguish wildfires in wilderness areas or let them burn. They pull out two yellowed documents from the early 1980s, which foresters have used in the ensuing decades to put policies into practice on the ground, and half a dozen maps showing how fires have shaped the 1.5 million-acre Bob Marshall Wilderness Complex landscape since then.

“In 32 years, we have seen some significant fire activity on the landscape,” Munoz said….

McBratney and Munoz point toward this summer’s Red Shale fire as a textbook example of fire management, even though it is still burning after being started by lightning on July 18, about 35 miles west of Choteau. The fire has spread over 12,380 acres in a typical mosaic pattern, burning trees in one area but leaving others standing. Most of the burned area is within the footprint of the Gates Park fire, which ended up totaling about 52,000 acres.

They do more up-front planning, which includes examining various long-term scenarios. They get daily briefings on weather. More resources are in place — both people and equipment — if it’s needed. They map using satellites and infra-red radars. The develop models on where the fire is expected to burn and revisit those models regularly to tweak them.

Public information officers posted daily updates on a fire’s size, location and the number of resources assigned to it in Choteau and Augusta. There’s even an “app” that allows cell phones to scan it and go directly to the online “InciWeb,” a national incident management website that posts fire information, to learn more about the Red Shale fire.

Even if they’re not actively trying to extinguish the flames, they still use helicopters to drop water to cool the blaze and try to direct it away from some areas. They’ve wrapped historic cabins with fire-resistant materials and installed sprinklers as protective measures.

At the height of the Red Shale fire, about 25 people were assigned to it, including about 10 people on the ground. Today, four people are watching the fire, which is mainly smoldering after recent rains and cooler fall temperatures.

Today, after 100-plus fires in the Bob Marshall Complex have burned hundreds of thousands of acres since 1980, there’s less fuel to add to the fires. Munoz points to the Red Shale fire map, which shows how it burned to the edge of the 2001 Biggs Flat fire, then stopped without human intervention.

In addition to the natural fires within the wilderness area, forest officials have used prescribed burns to remove fuels outside the boundaries, with the hope that will make it easier to catch a fire that makes a run toward private property.

They’ve also worked on building relationships with local and state firefighters. McBratney is a member of the Augusta volunteer fire department, and Stiger said that during the recent fire season local volunteers meet weekly with state and federal representatives to talk about potential issues.

Currently, most of those conservation efforts focus on preserving mature forests where birds breed, but the new research shows younger forest habitat may be vital in the weeks leading up to migration.

“Humans have really changed the nature of mature forests in the Northeast,” said Scott Stoleson, a research wildlife biologist at the U.S. Forest Service’s Northern Research Station. “Natural processes that once created open spaces even within mature forests, such as fire, are largely controlled, diminishing the availability of quality habitat.

The study suggests that declines in forest-interior species may be due in part to the increasing maturity and homogenization of forests. Openings created by timber harvesting may increase habitat for some forest interior birds, according to Stoleson. “Humans have really changed the nature of mature forests in the Northeast,” Stoleson said. “Natural processes that once created open spaces even within mature forests, such as fire, are largely controlled, diminishing the availability of quality habitat.”

In 217 days of netting birds over the course of the 4-year study, Stoleson netted and banded a total of 3,845 individuals. Of these, 2,021 individuals representing 46 species were in the postbreeding stage, based on physiological criteria. Of these, 33 percent were mature-forest specialists, 22 percent were forest-edge species, and the remaining 45 percent were early-successional specialists. All 46 species were captured in cuts, but only 29 species were captured within forest.

Just a reminder that “science” is a function of what is looked at, at what place, species and spatial scale, and our knowledge is only provisional. It seems like this is sometimes forgotten and we expect more than “science” can deliver.
